Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period:
The period within which the consumer may exercise their right of withdrawal.

Consumer:
The natural person who does not act in the course of business or profession and enters into a distance contract with the entrepreneur.

Day:
Calendar day.

Ongoing transaction:
A distance contract relating to a series of products and/or services for which the delivery and/or purchase obligation is spread over time.

Durable data carrier:
Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal:
The option for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur:
The natural or legal person who offers products and/or services to consumers at a distance.

Distance contract:
A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby the contract is concluded exclusively through one or more means of distance communication.

Means of distance communication:
Any means that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place.

General Terms and Conditions:
These present Terms and Conditions of the entrepreneur.


Article 2 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 30 days without giving any reason. During the cooling-off period, the consumer shall handle the product and its packaging with care.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, if reasonably possible, in its original condition, in accordance with the entrepreneur’s reasonable instructions.


Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated before the distance contract is concluded where the Terms and Conditions can be consulted and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, these Terms and Conditions may be provided electronically in such a way that they can be stored by the consumer on a durable data carrier.

If additional specific product or service terms apply alongside these Terms and Conditions, the consumer may always rely on the provision that is most favorable to them in the event of conflicting terms.

If any provision of these Terms and Conditions is wholly or partially void or annulled, the remaining provisions remain in force. The invalid provision shall be replaced by a provision that most closely reflects the intent of the original.

Matters not regulated in these Terms and Conditions shall be assessed in accordance with the spirit of these Terms and Conditions. Ambiguities shall likewise be interpreted in accordance with their spirit.


Article 4 – The Offer

If an offer has a limited validity or is subject to conditions, this shall be clearly stated. All offers are non-binding. The entrepreneur may amend or withdraw offers.

Offers include a complete and accurate description of products and/or services sufficient for consumers to make an informed decision. Images are illustrative and errors do not bind the entrepreneur.

Colors may differ slightly from actual products. Specifications are indicative and cannot give rise to compensation or dissolution.

Offers include clear information on:

  • Shipping costs

  • How the contract is concluded

  • Applicability of the right of withdrawal

  • Payment, delivery, and performance methods

  • Acceptance period

  • Distance communication costs

  • Archiving and accessibility

  • Correction of data

  • Available languages

  • Codes of conduct

  • Minimum duration of ongoing contracts

  • Optional: sizes, colors, materials


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and fulfills the conditions.

Electronic acceptance is confirmed by the entrepreneur. Until confirmation is received, the consumer may dissolve the contract.

The entrepreneur ensures secure data transmission and payment processing.

The entrepreneur may assess the consumer’s creditworthiness and refuse orders or impose conditions.

The entrepreneur shall provide written or electronically storable information regarding complaints, withdrawal, guarantees, and termination requirements.

Contracts are concluded subject to availability.


Article 6 – Right of Withdrawal

Consumers may withdraw from product purchases within 30 days after receipt.

Products must be handled carefully and returned with all accessories and, if possible, in original packaging.

Consumers must notify withdrawal in writing or by email and return products within 30 days, providing proof of shipment.

Failure to do so finalizes the purchase.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

Refunds are issued within 30 days after receipt or proof of return.


Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for:

  • Custom-made products

  • Personalized products

  • Non-returnable items

  • Perishable goods

  • Market-price dependent goods

  • Newspapers/magazines

  • Unsealed media/software

  • Unsealed hygiene products


Article 9 – Price

Prices remain unchanged during offer validity except VAT changes.

Variable pricing may apply due to financial market fluctuations.

Errors in pricing do not bind the entrepreneur.


Article 10 – Conformity and Warranty

Products must meet legal standards and specifications.

Warranties do not affect statutory rights.

Defects must be reported within 30 days.

Warranty does not apply to misuse, improper handling, or unauthorized repairs.


Article 11 – Delivery and Performance

Orders are fulfilled within 30 days unless otherwise agreed.

Delays entitle the consumer to cancel and receive a refund.

Replacement products may be provided.

Risk remains with the entrepreneur until delivery.


Article 12 – Ongoing Transactions

Consumers may cancel ongoing agreements at any time with up to one month’s notice.

Automatic renewal rules and trial subscriptions are regulated.


Article 13 – Payment

Payments must be made within seven working days after the cooling-off period begins.

Incorrect payment details must be reported immediately.

Reasonable collection costs may be charged.


Article 14 – Complaints Procedure

Complaints must be submitted within seven days of discovery.

Responses are provided within 14 days.

Valid complaints may result in replacement or repair.


Article 15 – Disputes

All agreements are governed exclusively by Belgian law, even if the consumer resides abroad.
